Terms of Service

These Terms of Service ("Terms") govern your use of MyTBox ("the Service"), operated by NEXSTREAM CORP. ("we", "us", "our"). By creating an account, subscribing, or using the Service, you agree to these Terms.

1. What MyTBox is

MyTBox is a browser-based tool that lets a vehicle owner read diagnostic and health information from their own vehicle, over a local wired connection, using a compatible diagnostic cable that you supply. It presents data your vehicle already exposes in plain language. MyTBox is read-only: it reads information the vehicle provides and does not send commands, change settings, modify firmware, or alter your vehicle in any way.

2. Authorized use only

You may use the Service only to read data from a vehicle that you own or are expressly authorized to access. You are responsible for ensuring your use complies with all applicable laws and any agreements you have with your vehicle's manufacturer. You must not access a vehicle without the owner's consent.

3. No affiliation with the manufacturer

MyTBox is an independent product. It is not affiliated with, endorsed by, sponsored by, or connected to Tesla, Inc. or any vehicle manufacturer. All manufacturer and model names and logos are the property of their respective owners and are used for descriptive purposes only.

4. Dependence on third-party vehicle access

The Service works by reading data your vehicle makes available through its own diagnostic interface. This access is provided by the vehicle and its manufacturer, not by us, and is outside our control. If the manufacturer changes, restricts, disables, or removes this diagnostic access — by software update, policy change, or otherwise — the Service may stop working for some or all vehicles, in whole or in part.

We are not responsible for, and cannot be held liable for, any loss of functionality caused by manufacturer changes to vehicle access. If such a change makes the Service unable to function for your vehicle, we will stop billing your subscription as soon as reasonably possible, and you may cancel at any time as described in Section 7.

5. No warranty; not professional advice

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, to the maximum extent permitted by law. MyTBox is an informational tool and is not a substitute for professional diagnosis, inspection, or service by a qualified technician.

6. Subscription, billing, and the connection-first model

• Pricing: the current price is shown on our Pricing page. Price changes will not affect your current paid period.
• Connection-first billing: you can connect to your vehicle and confirm a working connection before you are charged. Billing begins only when you choose to subscribe to unlock live data.
• Recurring billing: subscriptions are monthly and recurring, renewing automatically each month at the then-current fee until you cancel.
• Payments & Merchant of Record: payments are processed by Paddle, which acts as the Merchant of Record and handles billing, invoicing, and applicable taxes. Paddle's Buyer Terms also apply.

7. Cancellation and refunds

• Cancel anytime: cancellation stops all future billing. You retain access until the end of the period already paid for.
• Refunds: payments are processed by Paddle (our Merchant of Record) and all refunds are governed by Paddle's Refund Policy, which applies in full. Unless required by applicable law, transactions are non-refundable; Paddle may grant a refund at its discretion within 14 days of purchase, assessed case-by-case, and approval is not guaranteed. See our Refund & Cancellation Policy.
• Statutory rights: where local consumer-protection laws grant a statutory right of withdrawal or cancellation, those rights apply.

8. Acceptable use

You agree not to misuse or disrupt the Service; access vehicles you are not authorized to access; reverse-engineer the Service except as permitted by law; resell or redistribute it without our written permission; or use it for any unlawful purpose. We may suspend or terminate accounts that violate these Terms.

9. Limitation of liability

To the maximum extent permitted by law, NEXSTREAM CORP. and its officers and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or vehicle availability, arising from your use of (or inability to use) the Service. Our total liability for any claim will not exceed the amount you paid us in the three (3) months before the claim arose.

10. Changes to these Terms

We may update these Terms. Material changes are reflected by the "Last updated" date and, where appropriate, communicated by email. Continued use after changes take effect constitutes acceptance.

11. Governing law

These Terms are governed by the laws of the State of New York, United States, without regard to its conflict-of-laws rules, subject to any mandatory consumer-protection rules of your country of residence.
